DMCA Policy

Severe Weather Texas ("we," "us," or "our") respects the intellectual property rights of others and expects its users to do the same. In accordance with the Digital Millennium Copyright Act of 1998 (DMCA), the text of which may be found on the U.S. Copyright Office website at http://www.copyright.gov/legislation/dmca.pdf, we will respond expeditiously to claims of copyright infringement committed using the Severe Weather Texas website and/or online services (the "Site") if such claims are reported to our Designated Copyright Agent identified below.

Please note that this procedure is exclusively for notifying Severe Weather Texas and its affiliates that your copyrighted material has been infringed.

Filing a DMCA Notice of Infringement

If you are a copyright owner, or are authorized to act on behalf of one, or authorized to act under any exclusive right under copyright, please report alleged copyright infringements taking place on or through the Site by completing the following DMCA Notice of Alleged Infringement and delivering it to our Designated Copyright Agent.

Upon receipt of the Notice as described below, we will take whatever action, in our sole discretion, we deem appropriate, including removal of the challenged material from the Site.

  1. **Identification of the copyrighted work:** Clearly identify the copyrighted work you claim has been infringed, or if multiple copyrighted works are covered by this Notice, you may provide a representative list of the copyrighted works that you claim have been infringed.
  2. **Identification of the infringing material:** Identify the material that you claim is infringing (or to be the subject of infringing activity) and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit us to locate the material, including, at a minimum, if applicable, the URL of the link shown on the Site where such material may be found.
  3. **Contact Information:** Provide your mailing address, telephone number, and, if available, email address.
  4. **Statement of good faith belief:** Include both of the following statements in the body of the Notice:
    • "I have a good faith belief that the use of the copyrighted material is not authorized by the copyright owner, its agent, or the law."
    • "The information in this notification is accurate, and under penalty of perjury, I am the copyright owner or am authorized to act on behalf of the copyright owner or an exclusive right that is allegedly infringed."
  5. **Electronic or Physical Signature:** Provide your full legal name and an electronic or physical signature (typing your full legal name is sufficient for an electronic signature).
  6. **Designated Copyright Agent:** Deliver this Notice, with all items completed, to Severe Weather Texas's Designated Copyright Agent:

Filing a DMCA Counter-Notification

If you believe that the material you posted on the Site was removed or access to it was disabled by mistake or misidentification, you may file a Counter-Notification with us by submitting written notification to our Designated Copyright Agent (identified above). Pursuant to the DMCA, the Counter-Notification must include substantially the following:

  • **Identification of the removed material:** Identify the material that has been removed or to which access has been disabled and the location (e.g., URL) at which the material appeared before it was removed or access to it was disabled.
  • **Statement under penalty of perjury:** A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.
  • **Consent to jurisdiction:** A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located, or if your address is outside of the U.S., for any judicial district in which Severe Weather Texas may be found, and that you will accept service of process from the person who provided the original DMCA notification or an agent of such person.
  • **Your Contact Information:** Your name, address, telephone number, and email address.
  • **Electronic or Physical Signature:** Your electronic or physical signature (typing your full legal name is sufficient for an electronic signature).

Upon receipt of a valid Counter-Notification, we will promptly provide the complaining party with a copy of the Counter-Notification and inform them that we will replace the removed material or cease disabling access to it in 10 business days. We will replace the removed material or cease disabling access to it in 10 to 14 business days following receipt of the Counter-Notification, provided our Designated Copyright Agent has not received notice from the original complaining party that an action has been filed seeking a court order to restrain the subscriber from engaging in infringing activity relating to the material on our system.
